Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you, the business or individual using the service (“you”, “Customer”), and DishGate (“DishGate”, “we”, “us”), operator of dishgate.com. By creating an account, accessing, or using the service you agree to these Terms. If you do not agree, do not use the service.
1. The service
DishGate is a software-as-a-service platform that lets restaurants and food businesses build a digital menu, publish it on a subdomain with QR codes, optionally accept dine-in orders that are transmitted to the restaurant, manage promotions, and view analytics. We provide the software only. We are not a restaurant, food vendor, payment processor, or delivery service, and we do not prepare, sell, or deliver food.
2. Eligibility & accounts
- You must be at least 18 years old and able to enter into a binding contract.
- You are responsible for the accuracy of your account information and for all activity under your account.
- You are responsible for keeping your password confidential and for any use of your account, authorised or not.
- You must notify us promptly at Contact@dishgate.com of any unauthorised use.
3. Customer content & responsibilities
You retain ownership of the content you upload (menu names, descriptions, prices, photos, 3D models, logos, branch information). You grant us a limited licence to host, process, and display that content solely to operate the service for you. You are solely responsible for your content, including:
- Accuracy of menu information — including prices, descriptions, allergen and dietary tags, and ingredient information. We do not verify allergen or food-safety information. You must ensure it is correct and compliant with the food-labelling and consumer laws that apply to you.
- Holding all rights to images, logos, and 3D models you upload, and not infringing any third party’s rights.
- Compliance with all laws applicable to your business, including food safety, hygiene, tax, and consumer protection.
We may remove content that we reasonably believe violates these Terms or any law, but we have no obligation to monitor content.
4. Guest orders
Where enabled, the ordering feature transmits a guest’s selection to you. DishGate is a conduit only. Any contract for food is solely between you and your guest. We are not a party to that transaction and are not responsible for: order accuracy or fulfilment, food quality or safety, allergen outcomes, pricing, taxes, payment collected at your counter, or any dispute between you and a guest. You are responsible for honouring, fulfilling, refunding, and resolving disputes about guest orders.
5. Subscriptions, billing & trials
- Paid plans are billed through our payment provider, Paddle.com Market Limited (Paddle), which acts as the Merchant of Record. Paddle processes your payment, issues invoices, and collects and remits applicable taxes. Your purchase is also subject to Paddle’s buyer terms.
- Paid plans may include a 14-day free trial. The free Starter plan has no time limit.
- Subscriptions renew automatically each billing period (monthly or annual) until cancelled. You authorise recurring charges until you cancel.
- You may cancel at any time; cancellation stops future renewals. Access continues until the end of the paid period.
- Refunds are governed by our Refund Policy.
- We may change prices or plan features. We will give reasonable notice, and changes take effect at your next renewal. Continued use after a change means you accept it.
6. Plan limits
Each plan has limits (branches, items, AR dishes, table QR codes, promotions, and features such as ordering and full analytics). If you downgrade, your data is preserved, but content exceeding the lower plan’s limits may become read-only until you upgrade again.
7. Acceptable use
You agree not to:
- Use the service for anything unlawful, deceptive, or harmful;
- Upload malware, attempt to breach security, scrape, overload, or reverse-engineer the service;
- Resell or provide the service to third parties except your own restaurant operations;
- Upload content that is illegal, infringing, or that you have no right to use;
- Misrepresent prices or menu information in a way that misleads consumers.
8. Intellectual property
The DishGate platform, software, design, and trademarks are owned by us. These Terms grant you no rights in them except the limited right to use the service per these Terms.
9. Third-party services
We rely on third-party providers (including for hosting, payments, and fonts) to deliver the service. Their availability is outside our control, and we are not liable for their acts or outages. See our Privacy Policy for the sub-processors we use.
10. Disclaimers
The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that AR features will work on every device. AR availability depends on the guest’s device and operating system.
11. Limitation of liability
To the maximum extent permitted by law, DishGate and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the service. Our total aggregate liability for all claims relating to the service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) USD 100. Nothing in these Terms excludes liability that cannot be excluded by law.
12. Indemnification
You will indemnify and hold harmless DishGate from any claims, damages, liabilities, and costs (including reasonable legal fees) arising from your content, your menu or pricing, your guest orders, your use of the service, or your breach of these Terms or any law.
13. Suspension & termination
You may stop using the service at any time. We may suspend or terminate your account if you breach these Terms, fail to pay, or use the service in a way that risks harm to us or others. On termination, your right to use the service ends. We may delete your data after a reasonable period following termination.
14. Governing law & disputes
These Terms are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-law rules. You and we submit to the exclusive jurisdiction of the competent courts of Cairo, Egypt, except that we may seek injunctive relief in any competent court. If any provision is found unenforceable, the rest remain in effect.
15. Changes to these Terms
We may update these Terms from time to time. We will update the “Last updated” date and, for material changes, provide reasonable notice. Continued use after changes take effect means you accept the revised Terms.
